Community Associations

Robbins May & Rich LLP lawyers represent owners associations in condominium, townhouse, and single-family communities as well as in retail shopping centers and mixed-use communities. We also represent lot owners and developers in the transfer of control of community associations and common areas to lot owners after the substantial completion of real estate developments. We strive to provide experienced counsel and clear advice to boards of directors in proper governance and administration of community associations.

Our attorneys review and interpret association documents, draft association documents and amendments, prepare collection assessment policies and procedures, and provide assistance in the enforcement of rules, covenants, and restrictions.  Our attorneys often meet with new directors in an effort to advise them of their legal obligations in the discharge of their duties, potential liabilities, and relationship to the members of the association.  These issues encompass compliance with state and federal laws including the North Carolina Condominium Act, the North Carolina Planned Community Act, the North Carolina Nonprofit Corporation Act, the North Carolina Debt Collection Act, and the federal Fair Debt Collection Practices Act.

We also represent associations disputes related to violations of restrictive covenants, rules and regulations, and architectural requirements.  We recognize that many of these disputes involve neighbors, and, therefore, we strive to resolve these disputes without resort to litigation. However, if a resolution is not forthcoming, we have successfully litigated at the request of our clients to enforce the requirements set forth in their governing documents.
